I'm making a free (non-profit) Dark Fantasy/Steampunk rogue-like game with an original lore and art (including the monsters), the thing is that I want to have some of the concepts of D&D creatures beacause it fist into my world and I love them, some of them will have reinterpretantions, some not, but all of them will have original backstory, descriptions and pixelart sprites, the thing is, can I get into legal problems if I use Sprites too similar to already existing D&D monsters?
For example, one of my custom races, the Inklings are pretty similar to the Illithids, but that's because I base them off Cthulhu, so they have differences, for example they're winged and have starfish like hands, use Ink as magic due to being in their blood, and have asexual reproduction, borning by an Ink safrice, transforming another creature into Ink Blood and forming a Inkling Fetus, this being entirelly different from the D&D Illithis, but they look alike, so this falls under 'fair use'?
Also the Official Fan Content Policy does not talk about videogames (maybe I miss something).
So would I run into any problems?
